These Terms & Conditions ("Terms") govern your access to and use of the HYPERLIQUID website (the "Site") and the purchase of any HYPERLIQUID products (the "Products"), operated by Hyper Liquid Labs LLC ("Hyper Liquid Labs," "we," "our," or "us"). By using the Site or placing an order, you agree to these Terms.

1. Eligibility & age requirement

HYPERLIQUID products contain caffeine and bioactive peptides and are intended for healthy adults aged 18 or older. By using the Site or purchasing Products, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding contract. Products are not intended for children, pregnant or nursing women, people sensitive to caffeine, or individuals with any medical condition. Consult a physician before use.

2. Products & performance claims

All performance, recovery and cognitive descriptions on the Site are provided for informational purposes. HYPERLIQUID is a dietary supplement beverage; it is not a drug and is not intended to diagnose, treat, cure or prevent any disease. Individual results vary. Statements regarding ingredients have not been evaluated by the U.S. Food and Drug Administration.

3. Orders, pricing & payment

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to refuse, limit or cancel any order at our discretion, including for suspected fraud, pricing errors or stock limitations. Charges are processed at the time your order is confirmed.

4. Shipping, returns & subscriptions

Shipping, refund and subscription terms are described in our Shipping & Returns policy and are incorporated into these Terms by reference. Subscriptions renew automatically at the cadence selected at checkout until canceled by you.

5. Acceptable use

You agree not to misuse the Site, including but not limited to attempting to gain unauthorized access, reselling Products without written authorization, scraping the Site, or using the Site to transmit unlawful or harmful content.

6. Intellectual property

The Site, the HYPERLIQUID name and logo, product designs, formulas, copy, photography and all related materials are the property of Hyper Liquid Labs LLC and are protected by U.S. and international intellectual property laws. No license is granted to you by these Terms except the limited right to view and purchase Products for personal, non-commercial use.

7. Disclaimers

The Site and Products are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Hyper Liquid Labs LLC, its affiliates, officers, employees and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising from your use of the Site or Products. Our total liability for any claim related to the Site or a Product shall not exceed the amount you paid for the Product giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Hyper Liquid Labs LLC from any claims, damages, liabilities, losses, and expenses arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

10. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the latest revision. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
